MyMahotsav Event and Tickets Marketplace Disclaimer & Terms of Liability
1. Introduction and Purpose
This Event Disclaimer and Liability Terms (“Agreement,” “Disclaimer,” or “Terms”) is a legally binding document governing the use of the MyMahotsav platform in relation to events, festivals, cultural programs, community gatherings, workshops, rituals, and other listed activities (“Events”).
MyMahotsav (“the Platform,” “we,” “us,” or “our”) is a digital faith-tech and cultural ecosystem designed to connect communities, temples, organizations, and individuals. While the Platform provides digital tools to list, promote, discover, and sometimes ticket or fund such Events, it is not the organizer, producer, or responsible party for the conduct of Events.
By hosting or attending any Event through MyMahotsav, you (“Host,” “Organizer,” “Attendee,” “Guest,” “User”) expressly agree that:
MyMahotsav acts solely as a marketplace aggregator and technology facilitator.
All liabilities associated with the Event — including safety, compliance, accuracy, performance, refunds, and conduct — remain the sole responsibility of the Host and/or the Attendee.
MyMahotsav shall not, under any circumstances, be held responsible for claims, damages, losses, cancellations, injuries, delays, disputes, or any form of liability arising out of Events, except to the limited extent of technical facilitation within the Platform.
This Disclaimer is structured to safeguard MyMahotsav from legal exposure while ensuring clarity for users.
2. Definitions
For the purposes of this Agreement:
“Platform” means MyMahotsav, its website (mymahotsav.com), mobile applications, sub-domains, tools, and any digital or communication service owned or operated under the MyMahotsav brand.
“Event” refers to any program, celebration, ritual, cultural show, religious function, festival gathering, workshop, online puja, or other activity listed or promoted on the Platform by a Host.
“Host” or “Organizer” means any temple, trustee, cultural organization, charity, company, group, or individual that lists, promotes, manages, or operates an Event via the Platform.
“Attendee,” “Guest,” or “Participant” means any user, devotee, customer, or individual who registers, books, donates to, or attends an Event.
“Transaction” means any ticket purchase, booking, donation, subscription, or financial transfer between Host and Attendee facilitated (wholly or partly) via the Platform.
“Dispute” means any conflict, claim, or disagreement arising between Host and Attendee in relation to an Event.
“Force Majeure” refers to circumstances beyond reasonable control, including natural disasters, pandemics, strikes, terrorism, government action, or infrastructure failures.
3. Scope of MyMahotsav’s Role
3.1 Aggregator, Not Organizer
MyMahotsav is an intermediary technology provider. We enable:
Event discovery and listing.
Ticket booking, registrations, and optional donation facilitation.
Tools for Hosts to promote Events.
Digital touchpoints for Attendees to learn, engage, and participate.
We do not:
Produce, manage, or operate Events.
Verify the authenticity of rituals, spiritual practices, or cultural claims.
Guarantee attendance, safety, or satisfaction.
Control or supervise the conduct of Hosts, priests, volunteers, or attendees.
3.2 Limited Mediation Role
MyMahotsav may provide limited mediation support in the event of disputes. However, we:
Do not arbitrate legally binding disputes.
Cannot enforce refunds, cancellations, or compensations.
May, at our discretion, suspend or delist non-compliant Hosts.
3.3 Neutral Marketplace
The relationship between Host and Attendee is direct and contractual. MyMahotsav is neither a party to nor liable under such contracts.
4. Host Responsibilities
Hosts acknowledge and accept the following obligations:
4.1 Accuracy of Listings
Hosts must provide truthful, updated, and complete Event details (e.g., date, time, venue, ticket types, pricing, inclusions, rituals, and restrictions). MyMahotsav is not liable for misinformation.
4.2 Legal & Regulatory Compliance
Hosts are solely responsible for:
Obtaining permits, licenses, and religious permissions.
Ensuring compliance with public safety, food standards, and fire codes.
Adhering to taxation laws (e.g., GST, VAT, charity regulations).
4.3 Financial Accountability
Hosts must manage refunds, cancellations, and chargebacks directly.
Funds disbursed via the Platform are not held in trust by MyMahotsav.
Hosts agree to indemnify MyMahotsav against any financial claims.
4.4 Safety & Insurance
Hosts must:
Ensure venue safety, crowd management, and medical support.
Arrange liability insurance where applicable.
Take responsibility for volunteer and staff conduct.
4.5 Roles & Transparency
Hosts must disclose trustees, leaders, or officials linked to the Event. This transparency builds trust and reduces reputational risk.
5. Attendee Responsibilities
Attendees agree and accept:
5.1 Risk Assumption
Participation in Events carries inherent risks, including injury, illness, or dissatisfaction. Attendees accept these risks and release MyMahotsav from liability.
5.2 Verification
Attendees must verify Event details before purchase. MyMahotsav does not warrant accuracy beyond what the Host provides.
5.3 Refunds & Cancellations
Refunds are managed solely by Hosts. MyMahotsav bears no responsibility for refund disputes.
5.4 Conduct
Attendees must:
Follow Event rules and cultural decorum.
Avoid disruptive or unlawful behavior.
Respect the sanctity of rituals and traditions.
6. Transactions, Payments, and Refunds
Payment gateways are third-party providers. MyMahotsav does not process or hold funds directly except for platform fees.
Refunds are at the discretion of Hosts. MyMahotsav’s role is limited to facilitating technical tools.
In the case of fraudulent events, MyMahotsav may suspend Hosts but bears no liability to attendees beyond platform fees collected.
7. Transparency and Accountability
Hosts can display trustees, roles, and volunteers associated with their organization.
Attendees can view the individuals behind Events, with roles marked as “Active” or “Past.”
This dual-transparency ensures reputational accountability and builds community trust.
8. Dispute Resolution
MyMahotsav is not a formal dispute arbitrator.
Hosts and Attendees must resolve disputes independently.
MyMahotsav may provide optional tools (e.g., communication, reporting, mediation) but with no guarantee of outcome.
9. Force Majeure
Neither Hosts nor MyMahotsav shall be liable for non-performance due to Force Majeure events. Examples include natural disasters, pandemics, government restrictions, or technical failures.
10. Indemnification
Both Hosts and Attendees agree to indemnify and hold harmless MyMahotsav, its officers, employees, and affiliates against claims, damages, or liabilities arising from Events, except in cases of direct negligence by MyMahotsav.
11. Limitation of Liability
To the maximum extent permitted by law:
MyMahotsav’s liability is strictly limited to platform fees collected for a disputed transaction.
MyMahotsav is not liable for lost profits, reputational harm, injuries, or incidental damages.
12. Intellectual Property
Hosts grant MyMahotsav the right to use Event content (logos, images, descriptions) for promotion. Hosts warrant ownership or appropriate licensing for uploaded content.
13. Governing Law
This Agreement shall be governed by the laws of England & Wales (or applicable jurisdiction). Disputes shall fall under the exclusive jurisdiction of relevant courts.
14. Amendments
MyMahotsav may amend these terms at any time. Continued use of the Platform implies acceptance of updated terms.
15. Final Acceptance
By using MyMahotsav, you confirm that you have read, understood, and agreed to this Disclaimer.
